1. Who we are
This website is operated by EMIT Yachts (EMIT Boats S.A.E.), a yacht builder based in Hurghada, Egypt (“we”, “us”, “our”). EMIT Yachts is the sole data controller for all personal data collected through this website. EMIT Yachts alone decides what data is collected, why it is collected, how it is used, and how long it is kept — and EMIT Yachts alone bears full responsibility and liability for that processing, including any failure to comply with applicable data protection law.
The website was built for EMIT Yachts by Ground Zero LLC, acting purely as a technical service provider under contract. Ground Zero LLC has no role as a data controller: it does not own, sell, rent, or decide the purposes or means of processing of any personal data collected through this website, and it is not responsible for EMIT Yachts's data processing practices or compliance. All decisions about personal data — and all resulting responsibility — rest with EMIT Yachts alone.
EMIT Yachts has offices in Egypt (Hurghada), the United Arab Emirates (Dubai) and Spain (Barcelona). This single policy is issued for all of them: the European Union's General Data Protection Regulation (GDPR), Egypt's Personal Data Protection Law (No. 151 of 2020) and the UAE's Federal Decree-Law No. 45 of 2021 apply to our processing, and where those laws differ we apply the stricter standard.
2. Scope of this policy
This policy applies to everyone who uses this website, including visitors in the European Union / European Economic Area (covered by the GDPR), in Egypt (covered by Law No. 151 of 2020 on the Protection of Personal Data), and in the Gulf Cooperation Council countries (including Saudi Arabia's Personal Data Protection Law, the UAE's Federal Decree-Law No. 45 of 2021 on Personal Data Protection, and Qatar's Law No. 13 of 2016). Where those laws impose obligations on us, we comply with the stricter applicable standard.
3. Information we collect
We collect information you provide directly, including:
- Your name, email address, phone number, and country when you contact us or submit a request form.
- Model and specification preferences you share with our sales team.
- Any messages or attachments you send us.
We also collect limited technical data automatically — such as browser type, device, and pages visited — to keep the site working and secure. On the public website we use Meta Pixel (Facebook) to measure visits and advertising performance; Meta may receive page-view and related technical data as described in our Cookie Policy.
Sensitive data. We do not intentionally collect special-category data (such as health, religious, or biometric data). If you volunteer such information in a message, we process it only as necessary to respond to your enquiry and delete it as soon as it is no longer needed.
4. How we use your information
- To respond to your enquiries and provide quotations.
- To arrange facility visits, sea trials, and events you request.
- To manage warranty, support, and ownership services (EMIT Care).
- To improve our website and services.
We do not sell your personal data to third parties. We do not use automated decision-making (including profiling) that produces legal or similarly significant effects about you.
5. Legal basis
We process personal data only where the law allows. Each purpose has its basis:
- Responding to your enquiry and preparing a quotation— steps taken at your request before entering into a contract (GDPR Article 6(1)(b); Egypt Law No. 151 of 2020; the UAE PDPL's contract / pre-contract exception).
- Managing an ownership or service relationship — performance of our contract with you.
- Sending marketing about models, events and offers — your consent only. Marketing consent is optional, unticked by default, and can be withdrawn at any time (§10).
- Keeping the website secure and reliable — our legitimate interest in protecting the service and its users, balanced against your rights (GDPR Article 6(1)(f)). Under the UAE PDPL, which has no general legitimate-interests basis, we rely on your consent or the contract exception.
- Meeting legal, tax and accounting obligations — compliance with the law.
6. How long we keep data
We keep personal data only as long as necessary, on this schedule:
- Enquiries that do not become customers — 24 months from your last contact with us, then deleted or anonymised.
- Customer, ownership and service records — for the relationship and then for the periods required for warranty, tax and accounting purposes (in Egypt, generally five years; equivalent periods where other law applies).
- Website security logs — 6 months.
- Error-monitoring data — 30–90 days, with personal data excluded from capture.
- Consent records (what you agreed to, and when) — kept while we rely on your consent and afterwards as evidence of compliance.
When you withdraw consent or ask us to delete your data, we delete or anonymise it without undue delay, except where the law requires us to keep it (for example, invoices). Data held in backups is removed as those backups rotate.
7. Sharing and international transfers
We share your data only with the specialist providers who help us operate, under written contracts that require them to protect it, and with authorities where the law requires it. Our providers act only on our documented instructions:
- Vercel Inc. — website hosting and delivery (production servers in the European Union, Frankfurt region);
- Supabase Inc. — database, authentication and file storage (data stored in the European Union, Frankfurt region);
- Sentry — error monitoring, configured to exclude personal data from capture;
- Hostinger — business email; Namecheap — domain registration.
Where data is transferred across borders — including between the EU/EEA, Egypt, the UAE and the United States — we ensure an appropriate safeguard: standard contractual clauses, an adequacy decision, your express consent, or a contract-based safeguard recognised under the applicable law (GDPR Articles 44–49; Egypt Law No. 151 of 2020 and its Executive Regulations; the UAE's Federal Decree-Law No. 45 of 2021). You can ask us for a copy of the safeguards we rely on.
8. Security and breach notification
We apply appropriate technical and organisational measures to protect personal data against unauthorised or unlawful processing, accidental loss, destruction, or damage. In the event of a personal data breach, we will notify the relevant supervisory authority (including Egypt's Data Protection Centre, and EU supervisory authorities where required) and affected individuals, as required by law and without undue delay.
9. Your rights
Under the GDPR, Egypt Law No. 151 of 2020, and the GCC data protection laws, you have the right to:
- Access the personal data we hold about you;
- Rectify inaccurate or incomplete data;
- Erase your data, where the legal conditions apply;
- Restrict processing in certain circumstances;
- Object to processing based on our legitimate interests;
- Object to direct marketing at any time — we stop immediately;
- Data portability — receive your data in a structured, machine-readable format, where applicable;
- Withdraw consent at any time, without affecting the lawfulness of processing carried out before withdrawal.
We respond to requests under these rights within the time limits required by applicable law — up to one month under the GDPR (extendable by two months for complex requests, with notice), and within the corresponding periods under Egyptian and UAE law. We may ask you to confirm your identity before acting, using the minimum information necessary. To exercise any of these rights, contact us at privacy@emityachts.com. We will never discriminate against you for exercising your rights.
10. Marketing communications
We only send marketing (email, WhatsApp or SMS) where you have opted in — for example by ticking the optional box on our enquiry form — or where the law otherwise permits. Every message tells you how to stop, and you can withdraw your consent at any time by replying STOP, using the unsubscribe link, or writing to privacy@emityachts.com. Withdrawal is free and does not affect processing carried out before it.
11. Do you have to give us your data?
You are never legally required to give us your personal data. Providing your details in an enquiry form is voluntary — but if you do not provide the fields marked as required, we cannot respond to your enquiry. For an ownership or service relationship, some information (for example, vessel and contact details) is necessary to provide the service you have asked for; we will tell you when a field is needed for that reason.
12. Children
This website and our services are intended for adults. We do not knowingly collect personal data from anyone under 18. If you believe a child has provided us with personal data, contact privacy@emityachts.com and we will delete it.
13. Complaints
If you believe we have not handled your personal data properly, contact us first at privacy@emityachts.com — we will do our best to resolve it. You also have the right to lodge a complaint with the data protection authority in your country of residence or where the alleged issue occurred, without prejudice to any other legal remedy. These include:
- Egypt — the Personal Data Protection Centre (PDPC), established under Law No. 151 of 2020;
- European Union / EEA — the supervisory authority of your country of residence, work, or where the alleged infringement occurred;
- United Arab Emirates — the UAE Data Office / the Federal Authority for Artificial Intelligence and Data;
- Spain — the Agencia Española de Protección de Datos (AEPD), where our Barcelona office is established;
- Other GCC states— Saudi Arabia's SDAIA, or Qatar's competent authority.
14. Cookies
This website uses essential cookies (portal sessions and the cookie that records your cookie notice acknowledgment) and Meta Pixel for advertising measurement on the public site. See our Cookie Policy for the full list and how to manage cookies in your browser.
